Data Processing Terms

Background.

The Customer, as used herein, refers to the client who provides consent to their personal data for advertising purpose to the contracting party Quantum Digital Media Inc. Internet Advertising Program – General Terms and Conditions (the “Terms of Service Agreement”). The Terms of Service Agreement require Quantum Digital Media Inc to process Personal Data on behalf of the Customer (Client), wherein the terms and conditions of this Data Processing Agreement shall apply.

This Data Processing Agreement (Agreement) sets out the additional terms, requirements and conditions on which Quantum Digital Media Inc will process Personal Data when providing services under the Terms of Service Agreement placed by the Customer. This Agreement contains the mandatory clauses applicable to Personal Data subject to the new data protection laws, which apply to the collection and processing of personal information for California, Connecticut, Colorado, Virginia and Utah as required by US state laws.

 

AGREED TERMS

  1. Definitions and interpretation

The following definitions and rules of interpretation apply in this Agreement.

  • Applicable Data Protection Law means the data protection and privacy law, if it exists on the Effective Date of this Agreement( the date of acceptance of providing your data on the lead form), governing the processing, storage, transfer or other use of Personal Data and privacy of certain individuals including the California Data Privacy Legislation (as applicable to Personal Data of individuals located in California under certain circumstances), the Colorado, Nevada, Utah, Virgina sEuropean Data Protection Legislation (as applicable to Personal Data of individuals located in the EU), and the UK GDPR (as applicable to Personal Data of individuals located in the UK), and its associated regulations, if and when in force from time to time.
  • California Data Privacy – https://oag.ca.gov/privacy/ccpa Legislation means the California Consumer Privacy Act (California Civil Code Sec. 1798.100 et seq., also known as the California Consumer Privacy Act of 2018), the California Privacy Rights Act (California Civil Code Sec. 1798.120 et seq., also known as the California Privacy Rights Act of 2020, in effect beginning January 1, 2023), and its associated regulations, if and when in force from time to time.  PERSONAL INFORMATION WE COLLECT 

For the purposes of this Privacy Policy, “personal information” shall mean individually identifiable information from or about an individual. We collect personal information when you access certain of the Site Offerings and complete the required information request form(s) and/or otherwise provide such information to us. The information that you must supply on the form(s) may include, without limitation: (a) the User’s e-mail address; (b) the User’s full name; (c) your telephone number; (d) your mailing address; (e) your gender; (f) your date of birth; (g) whether or not you have obtained insurance in the preceding thirty (30) days; (h) general information, depending on the type of insurance requested, regarding the your automobile, health, height/weight, home ownership status, status as a smoker/non-smoker, any history of serious illness and other similar information; and (i) any other information collected via the applicable Contact Services form. For purposes of this Privacy Policy, certain information provided in connection with item (h) in the preceding paragraph may be considered “Sensitive Information.”

NON-PERSONAL INFORMATION COLLECTION AND USE 

Computer IP Addresses/Browser Type: 

We may collect certain non-personally identifiable information about you and your desktop computer when you visit many of the pages of the Site. Behavioral Tracking: 

Quantum Digital Media, Inc and its third-party partners use Cookies, pixels and other tracking technology (collectively, “Tracking Technology”) to analyze trends, administer the Site, track Users’ movements around the Site and to gather demographic information about our User base as a whole. In addition, we partner with a third-party to use Tracking Technology in connection with the display of advertising on our Site and to manage the serving of our advertising on other websites. Our third-party partners may use Tracking Technology to gather information about your activities on the Site and other websites in order to provide you with advertising based upon your browsing activities and interests. If you wish to opt-out of having this information used for the purpose of serving you interest-based ads, you may opt-out by [INSERT CONTACT METHOD]. SECURITY OF YOUR PERSONAL INFORMATION 

We endeavor to safeguard and protect our Users’ personal information. When Users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). Where our registration/application process prompts Users to enter Sensitive Information (such as medical information and health insurance information), and when we store and transmit such Sensitive Information, that information is encrypted with advanced TLS (Transport Layer Security). Access to your personal information is strictly limited, and we take reasonable security measures to ensure that your personal information is not accessible to the public. All of our Users’ personal information is restricted in our offices, as well as the offices of our third-party service providers. Only employees or third-party agents who need User personal information to perform a specific job are granted access to User personal information. Our employees are dedicated to ensuring the security and privacy of all User personal information. Employees not adhering to our firm policies are subject to disciplinary action. The servers that we store User personal information on are kept in a secure physical environment. We also have security measures in place to protect the loss, misuse and alteration of personal information under our control. DELETING, MODIFYING AND UPGRADING YOUR INFORMATION 

At your request, we will: (a) inform you of what personal information we have on file for you; (b) amend the personal information that we have on file for you; and/or (c) remove personal information that you have provided to us, or that we have otherwise collected.
